Shropshire’s Heritage Heroes



These terms and conditions set out the terms of use on which you may make use of Shropshire Council’s Shropshire Heritage Heroes website (‘the Website’).

Please read these terms of use carefully before you start to use the Website, as these will apply to your use of the Website. We recommend that you print a copy of this for future reference.

By using the Website, you confirm that you accept these terms of use and that you agree to comply with them and with policies, guidelines and terms linked by way of URLs . (“the Terms”).

If you do not agree to the Terms, you must not use the Website.

5.1 The Website is a ‘crowd-sourcing’ mechanism that is being used by Shropshire Council to generate enhanced records that will in due course be used by users of the Discovering Shropshire’s History website which will sit on

5.2 You acknowledge that the Website may allow people to interact online with the other users and members of Shropshire Council on a real time basis. Because of this Shropshire Council will not always be able to regulate the data created and made available by users. As a result Shropshire Council has limited control, if any, over the quality, morality, legality, truthfulness or accuracy of various aspects of the website.

5.3 You acknowledge that: (a) by using the Website you may have access to material that may have rights under copyright and other applicable laws, and that except as described in this Agreement such rights are not transferred by mere use of the Website. You accept full responsibility and liability for your use of any material in violation of any such rights.

5.4 You agree that your modifications to records are not in any way based upon any expectation of compensation from Shropshire Council. You acknowledge that this Agreement does not assign or transfer ownership, title or interest of the intellectual property rights on the Website to you.

6. Licences and intellectual property rights

6.1 Subject to the terms of this Agreement, Shropshire Council hereby grants you a non-exclusive, royalty free and revocable licence to access and use the Website and use the material therein in accordance with the Terms for as long as you are in compliance with the Terms.

6.2 Users of the Website can modify records in various forms.

6.3 You understand and agree that by submitting your modifications to any area of the Website, you automatically grant (and you represent and warrant that you have the right to grant) to Shropshire Council an exclusive, worldwide, royalty-free, perpetual licence: (a) to use, reproduce and communicate your modifications within the Website and a right to sub-licence such use to users of the Website as long as the modifications are used by such users within the Website; and (b) to use and reproduce, and to authorise third parties to use and reproduce, any of your modifications in any or all media for research purposes, marketing and/or promotional purposes in connection with the Website.

6.4 You agree to use all best efforts to ensure that your modifications do not infringe any intellectual property rights of a third party. If you do use material of a third party it must be clearly referenced as such.

6.5 You agree that you do not own the account you use to access the Website, nor do you own any data that Shropshire Council stores on its associated servers submitted by others. Your intellectual property rights do not confer ownership of others′ data stored by or on behalf of Shropshire Council.

6.6 You must not use any part of the content on the Website for commercial purposes without obtaining a licence to do so from the licensor.

6.7 If you print off, copy or download any part of the Website in breach of the Terms, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Permitted use of images

6.8 Permission must be obtained to use images and data and will be charged for. Please enquire using the contact information provided on the Website.

Approach to copyright

6.9 The copyright in images reproduced by Shropshire Council belongs to a variety of organisations and individuals including the contributing collections that own the images and third party rights holders.

6.10 Shropshire Council have made all reasonable efforts to ensure that the reproduction of all images on this site is done with the full consent of copyright owners and the respective collections. Any queries in this respect should be addressed to [email protected]

6.11 Shropshire Council undertakes to remove images if requested to do so by rights holders. Such requests should be made to [email protected]

7. Community guidelines and policies

7.1 In addition to abiding at all times by the Terms, you agree that you shall not: (a) take any action to upload, post, email or otherwise transmit comments and descriptions made by other users of the Website (“Tags”) that infringe or violate any third party rights; (b) impersonate any person or entity without their consent, including but not limited to a Shropshire Council employee, or falsely state or otherwise misrepresent your affiliation with a person or an entity; (c) upload, post, email or otherwise transmit Tags that violate any United Kingdom law or regulation; (d) upload, post, email or otherwise transmit Tags determined by the Shropshire Council in its reasonable opinion to be libelous. You agree that Shropshire Council may take whatever steps it deems necessary to abridge or delete material on the Website in its sole discretion, without notice to you.

8. Limitation of liability

8.1 Nothing in the Terms excludes or limits our liability for death, or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English Law.

8.2 To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether express or implied.

8.3 We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

•    Use of, or inability to use, the Website; or

•    Use of or reliance on any content displayed on the Website.

8.4 If you are a business user, please note that in particular, we will not be liable for:

•    Loss of profits, sales, business, or revenue;

•    Business interruption;

•    Loss of business opportunity, goodwill or reputation; or

•    Any direct or consequential loss or damage.

8.5 If you are a consumer user, please note that we only provide the Website for domestic and private use. You agree not to use the Website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

9. Governing law

We both agree that the Terms, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the English Courts.

Information use

The Heritage Heroes website will ask you to provide some personal information: your name, address, telephone number and email address. This information will be used for administering your account.

As this project is being funded by the Arts Council of England they may periodically evaluate this information.

Information Sharing and Disclosure

Shropshire Council will only send personal information about you to other organisations for example other museum and archive services and project contributors. If you do not want us to share your information please email us using the contact page on this website.

Data Protection

Shropshire Council will use your information in accordance with the Data Protection Act 1998.
